1. Acceptance of Terms
By accessing, using, or engaging with any of the services, features, or content provided by us, you (the “Client,” “Landlord,” “Tenant,” “User,” or “you”) agree to fully accept, without modification, these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and us. If you do not agree to these Terms, you must immediately discontinue the use of our services, website, or any other related content. These Terms govern your use of our website, platforms, services, and the associated relationship between you and us.
By continuing to use our services, you also agree to be bound by all additional terms, policies, notices, or rules that we may make available in connection with specific services, which are incorporated into these Terms by reference. In some instances, specific services provided to you may have additional terms or conditions that will be provided to you separately and that will apply in addition to these Terms.
We reserve the right, at our sole discretion, to amend, update, or modify these Terms at any time. Changes will take immediate effect upon posting to the website or our digital platforms. You agree to periodically review the Terms for any updates or revisions. Continuing to access or use our services after any such change will constitute your acceptance of the revised Terms.
2. Scope of Services
We offer a wide range of property-related services, including but not limited to residential and commercial property sales, lettings, property management, advisory services, tenant placement, and property valuations. Our services are designed to assist both individual landlords and large property investors in managing and maintaining their property portfolios with ease and professionalism. Our specific offerings include:
Property Sales: Full-service marketing and sales support, including property valuation, market analysis, listing on major platforms, negotiation of offers, and management of all documentation associated with the sale process.
Letting Services: We facilitate the letting process by conducting viewings, referencing tenants, drafting tenancy agreements, collecting security deposits, and registering tenants’ details with relevant authorities. We ensure compliance with all regulatory requirements, including Right to Rent checks and deposit protection.
Property Management Services: This includes rent collection, regular property inspections, maintenance and repair coordination, compliance checks (such as gas safety, electrical inspections, EPCs), tenant liaison, and legal support. We also ensure that your property is marketed effectively, optimally positioned, and maintained to a high standard throughout the tenancy.
Advisory Services: Our team offers expert advice for landlords, investors, and property owners. This can include guidance on property acquisition, regulatory compliance, tenant relations, market trends, and investment strategy.
Our services are provided in accordance with individual agreements and may vary depending on the specific needs of each client or property. Any specific requirements, terms, and fees will be detailed in the individual Service Agreement.
3. Client Responsibilities
As a client, whether you are a property owner, landlord, or tenant, you acknowledge and agree to the following responsibilities:
Providing Accurate Information: You are responsible for ensuring that all information you provide, including personal details, property details, and financial information, is complete, accurate, and up-to-date. You also agree to inform us promptly if any changes occur that may affect the services we provide. Failure to provide accurate or complete information may result in delays or complications in the delivery of services.
Compliance with Legal and Regulatory Obligations: You agree to ensure that your property complies with all applicable laws, including safety regulations (e.g., gas safety, electrical inspections), tenancy laws, housing regulations, and any other legislation related to the management and letting of property. This includes ensuring that all certificates, permits, and inspections are completed and up-to-date.
Maintenance and Repairs: As the property owner, you are responsible for ensuring that the property is maintained in good condition and that any repairs required are carried out promptly. You agree to provide access to the property for inspection and maintenance purposes as needed. Additionally, you agree to cover any costs associated with necessary repairs and maintenance, either directly or through funds provided for property management.
Financial Obligations: You are required to pay all agreed fees, charges, and payments on time. Failure to make timely payments may result in additional charges, interest, or even suspension of services. You must ensure that adequate funds are available for us to process any payments or charges incurred in the course of our services.
Communication: You agree to maintain open communication with us, responding promptly to emails, letters, or phone calls. Effective communication is essential for ensuring the smooth operation of services, including the handling of queries, updates, and documentation requests.
4. Fees, Payments & Financial Protocols
Our fees for various services will be clearly outlined in the Service Agreement, which will detail the costs associated with our services, payment terms, and any additional charges that may apply. Some fees may include, but are not limited to:
Property Management Fees: Typically a percentage of the gross monthly rent collected, which covers the ongoing management of your property.
Letting Fees: These may include tenant placement fees, referencing fees, and contract administration fees.
Sales Fees: These may include a percentage of the sale price for successfully completed sales transactions.
Maintenance and Repair Charges: Charges for any maintenance or repairs that are not covered by the standard management fee will be invoiced separately.
You agree to pay all fees within the timeframe specified in the Service Agreement or as otherwise invoiced. Late payments may result in additional charges or the suspension of services. In cases where payments are not made as agreed, we reserve the right to take legal action to recover outstanding fees.
Payment for our services is typically made via bank transfer or other electronic payment methods. Invoices will be issued on a regular basis, with payment due within 30 days from the date of the invoice. Any overdue payments will incur interest at a rate of 8% above the Bank of England base rate or as permitted by law.
5. Property Management Services
When managing your property, we undertake to act in your best interests while ensuring compliance with all relevant legal requirements and regulations. Our services include the following:
Rent Collection: We will collect rent payments from tenants and remit the funds to you in a timely manner. Rent collection services also include reminders for overdue payments, and we will take appropriate action to recover any outstanding amounts.
Property Inspections: Regular inspections are conducted to ensure that the property is being maintained to a high standard. These inspections also help to identify any potential issues before they become serious problems. You will be notified of the inspection schedule in advance, and you may attend the inspection if you wish.
Maintenance & Repairs: We will coordinate the maintenance and repair of the property as necessary, including emergency repairs. All maintenance requests will be managed promptly to ensure that the property remains in good condition and complies with safety regulations.
Legal Compliance: We will ensure that the property meets all necessary legal requirements, including safety certifications, energy performance certificates (EPC), gas and electrical inspections, and any other compliance checks required under UK law.
Tenant Communication: We act as a liaison between you and your tenants, handling any queries, complaints, or issues that arise during the tenancy. We also handle rent increases, renewals, and notices, ensuring that all legal requirements are met.
6. Sales & Lettings Services
In addition to property management, we provide a comprehensive sales and lettings service designed to maximize the value of your property. This service includes:
Marketing the Property: We use a range of marketing channels, including online listings, print advertising, social media, and direct mail, to ensure maximum exposure for your property. We will work with you to create high-quality listings that attract potential tenants or buyers.
Tenant/Buyer Sourcing: We screen potential tenants or buyers through thorough background checks, including credit checks, employment verification, and previous landlord references, to ensure that they are financially responsible and suitable for your property.
Contract Drafting & Negotiation: Once a suitable tenant or buyer is found, we handle all the necessary documentation, including drafting tenancy agreements or sale contracts. We also manage negotiations to ensure favorable terms for you.
Tenant Placement: We coordinate the move-in process for tenants, including property handovers, key exchanges, and documentation signing. We also ensure that deposits are registered in a government-backed scheme as required by law.
7. Termination of Agreement
You or we may terminate the service agreement by providing 30 days’ written notice. Upon termination, all outstanding fees must be paid in full, and any unfinished matters must be resolved. In cases of immediate termination for reasons such as breach of contract, non-payment, or legal violations, the agreement may be terminated without prior notice.
If a property is under management at the time of termination, we will facilitate the transition and provide assistance in finding a new property manager or handling the sale or re-letting process as agreed.
8. Liability and Indemnity
You agree to indemnify and hold harmless our company, employees, agents, and contractors from any and all claims, damages, losses, or expenses, including legal fees, resulting from any act, omission, or failure on your part that causes a breach of these Terms. This includes, but is not limited to, any claim for damage or loss arising from failure to maintain your property in a safe and habitable condition, misrepresentation of property details, or failure to comply with relevant regulations.
In addition, you acknowledge and agree that we are not liable for any loss or damage arising from unforeseen events, including but not limited to acts of God, natural disasters (earthquakes, floods, etc.), fires, civil unrest, terrorism, or failure by third parties (e.g., contractors, suppliers, or utility companies). While we will use all reasonable efforts to manage and mitigate risks, you accept that some risks, especially those arising from external factors, are beyond our control.
9. Privacy and Data Protection
We take the protection of your personal data seriously and adhere to all applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. This section outlines how we collect, use, store, and protect your personal information.
